Terms & Conditions of Service

1. SCOPE OF SERVICES
The Mold Hound Co. provides canine-assisted mold detection services using a trained detection dog and certified handler. Our inspections are non-invasive and are limited to identifying potential mold-related odors and conditions within accessible areas of the inspected property.
THE MOLD HOUND CO. DOES NOT PROVIDE ANY OF THE FOLLOWING SERVICES, AND CLIENT EXPRESSLY ACKNOWLEDGES THIS LIMITATION:
• Mold remediation of any kind
• Referral of remediation contractors or vendors
• Written remediation protocols or scope-of-work documents
• Interpretation, assessment, or analysis of laboratory sample results
• Advice regarding whether a property is safe or unsafe to occupy
• Recommendations regarding remodeling, renovation, or structural modifications
• Recommendations regarding whether Client should vacate, move, or alter their use of the property
• Medical advice, health assessments, or guidance on health-related decisions
Any verbal or written communication from The Mold Hound Co. shall not be construed as a recommendation regarding remediation, occupancy, health decisions, renovation, or any other course of action. Client is solely responsible for all decisions made in response to inspection findings.

2. SAMPLING — DATA POINT DISCLAIMER
When air sampling, tape lift sampling, or swab sampling is performed as part of the inspection, Client expressly acknowledges and agrees to the following:
• All samples collected are a single point-in-time data point only. Results reflect conditions at the time and location of collection and are not indicative of overall property conditions.
• Air sample results are influenced by numerous variables including but not limited to: HVAC operation, ventilation, occupant activity, weather conditions, and time of collection. Results may vary significantly between samples taken in the same space at different times.
• Tape lift and swab samples identify mold presence on the specific surface sampled only and do not represent the presence or absence of mold elsewhere on the property.
• The Mold Hound Co. does not interpret, assess, diagnose, or provide conclusions based on laboratory results. Laboratory reports are provided to Client as received from the third-party laboratory without modification, analysis, or recommendation.
• Sampling results, whether elevated or normal, shall not be relied upon as a guarantee of the presence or absence of mold anywhere on the property.
• Client is responsible for engaging a qualified industrial hygienist, certified mold inspector, or other licensed professional to interpret laboratory results and advise on any appropriate response.

3. LIMITATIONS OF CANINE DETECTION
Canine mold detection is a highly effective but inherently imperfect method. Client expressly acknowledges and agrees:
• The Mold Hound Co. does not guarantee that all mold present on the property will be detected. Mold that is fully encapsulated, located within sealed wall cavities, above the dog's scent range, or otherwise inaccessible may not be detected.
• A negative result from a canine inspection does not guarantee the absence of mold on the property.
• A positive alert indicates a potential area of concern only and is not a definitive determination of mold presence, type, quantity, or extent.
• Detection may be affected by environmental conditions including humidity, temperature, airflow, competing odors, and property conditions at the time of inspection.
• The canine inspection is one tool within a broader mold evaluation strategy and should not be used as the sole basis for any decision regarding the property.

4. NO RECOMMENDATIONS OR ADVICE
THE MOLD HOUND CO. EXPRESSLY DISCLAIMS ANY OBLIGATION TO PROVIDE RECOMMENDATIONS, ADVICE, OR GUIDANCE REGARDING: remediation, occupancy, health and safety, renovation or remodeling, vendor selection, property value, legal or insurance matters, or any other course of action. Inspection findings are provided for informational purposes only. Client assumes full responsibility for all decisions made in response to any inspection findings.

5. PHOTOS, VIDEOS & MEDIA USE
• We collect photos and videos on each job for documentation, training, and marketing purposes.
• Our dog, Cash, may wear a camera during inspections to capture field footage.
• We may publicly share reviews, general inspection footage, or testimonials on our website and social media platforms.
• We may request client testimonials but participation is always voluntary.
• No names, addresses, or identifying features will be disclosed without prior written consent.
• All media remains the property of The Mold Hound Co.

6. CLIENT RESPONSIBILITIES
• Pet Control: All pets must be secured or removed from the property before and during the inspection. Failure to comply will result in cancellation and forfeiture of any deposit.
• Access: Client must provide clear, unobstructed access to all areas requested for inspection including crawlspaces, attics, and mechanical spaces.
• Disclosure: Client must disclose any known hazards, including but not limited to: asbestos, lead paint, structural instability, chemical contamination, or aggressive animals on the property.
• Safe Environment: Client is responsible for ensuring a safe working environment for the dog and handler at all times.

7. DEPOSITS & CANCELLATIONS
• Local Inspections: A non-refundable $250 deposit is required to secure an appointment.
• Cancellations with more than 48 hours notice may apply the deposit toward a new booking scheduled within 90 days.
• Cancellations with less than 48 hours notice forfeit the deposit in full.
• The Mold Hound Co. reserves the right to reschedule or cancel appointments due to weather, illness, unsafe site conditions, or other unforeseen circumstances.

8. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE MOLD HOUND CO.'S TOTAL LIABILITY TO CLIENT FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE INSPECTION SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY CLIENT FOR THE SPECIFIC INSPECTION SERVICE GIVING RISE TO THE CLAIM.
THE MOLD HOUND CO. SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO: LOSS OF PROPERTY VALUE, COSTS OF REMEDIATION, MEDICAL EXPENSES, RELOCATION COSTS, LOST INCOME, OR ANY OTHER DAMAGES ARISING FROM OR RELATED TO THE INSPECTION OR ANY DECISION MADE IN RELIANCE ON INSPECTION FINDINGS.
This limitation applies regardless of the theory of liability — whether in contract, tort, negligence, strict liability, or otherwise — and even if The Mold Hound Co. has been advised of the possibility of such damages.

9. PROPERTY DAMAGE
The Mold Hound Co. is not liable for minor incidental contact or cosmetic damage that may occur during the normal course of a non-invasive inspection, including but not limited to: minor scratches, scuffs, or inadvertent contact with furnishings. Client acknowledges that inspection access to crawlspaces, attics, and tight spaces may result in minor incidental contact with building materials.

10. CONFIDENTIALITY
Client identity, property address, and inspection findings are confidential. Photos or videos may be used for marketing, training, or educational purposes without identifying details unless Client provides prior written consent to include identifying information.

11. INDEMNIFICATION
Client agrees to indemnify, defend, and hold harmless The Mold Hound Co., its owners, agents, and assigns from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys fees) arising out of or related to: (a) Client's use of or reliance on inspection findings; (b) any decision made by Client in response to inspection findings; (c) Client's failure to fulfill their responsibilities under these Terms; or (d) any hazardous conditions on the property that were not disclosed prior to the inspection.

12. DISPUTE RESOLUTION
Any dispute arising out of or related to these Terms or the inspection services shall first be submitted to non-binding mediation. If mediation fails to resolve the dispute within 30 days, the parties agree to resolve the dispute by binding arbitration under the rules of the American Arbitration Association, applying the laws of the State of Georgia. The prevailing party shall be entitled to recover reasonable attorneys fees and costs.

13. FORCE MAJEURE
The Mold Hound Co. is not liable for delays or failures in performance resulting from events beyond its reasonable control, including but not limited to: natural disasters, acts of God, extreme weather, illness, regulatory changes, or pandemic-related restrictions.

14. ENTIRE AGREEMENT
These Terms & Conditions constitute the complete and exclusive agreement between Client and The Mold Hound Co. with respect to the inspection services. These Terms supersede all prior or contemporaneous agreements, representations, or understandings, whether written or oral.

15. SEVERABILITY & WAIVER
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Failure by The Mold Hound Co. to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

16. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions.

17. DEFINITIONS
• Canine / K9: Cash, the trained mold detection dog employed by The Mold Hound Co.
• Client: The individual, entity, or authorized representative hiring The Mold Hound Co. for inspection services.
• Inspection: The canine-assisted mold detection service provided by The Mold Hound Co.
• Sampling: Any air, tape lift, or swab samples collected during the inspection and submitted to a third-party laboratory for analysis.
• Laboratory Results: Reports generated by a third-party certified laboratory based on submitted samples. The Mold Hound Co. is not responsible for the accuracy, completeness, or interpretation of laboratory results.

We employ reasonable physical, electronic, and procedural safeguards to protect the information we hold from unauthorized access, disclosure, or alteration.6. Third‑Party Services
Should you elect to pursue independent laboratory testing, you will provide information directly to that laboratory. The Mold Hound Co. does not share your data with such vendors unless you request it in writing.7. Cookies & Website Analytics
Our website may use basic cookies or analytics tools to improve functionality. These do not collect personally identifiable information for marketing purposes.8. Children’s Privacy
Our services are not directed to individuals under 18. We do not knowingly collect information from children.9. Your Rights
You may request access to, correction of, or deletion of your personal information at any time by contacting us. We will respond within a reasonable timeframe.10. Changes to This Policy
